Certain services may require additional agreements such as Master Service Agreements (MSA) or Statements of Work (SOW).

When creating an account, you agree to:

• Notify us immediately of unauthorized access

7. Payments, Billing & Refunds

For paid services or SaaS subscriptions:

• Fees must be paid as per invoices, subscription plans, or contracts

• Delayed payments may result in suspension of service

7.2 Refund Policy

• Payments for completed work are non-refundable

• Subscription fees are non-refundable once the billing cycle starts

• Cancellation must be submitted before renewal to avoid new charges

• Prorated refunds apply only if explicitly agreed in a contract

We may use or integrate third-party tools, APIs, or platforms, such as:

9. Service Availability & Changes

• Uninterrupted access during maintenance

• That all features will be continuously available

We may:

• Update, modify, or discontinue features

• Introduce new functionality

10. Limitation of Liability

To the fullest extent permitted by law:

• Enabler Innovations is not liable for indirect, incidental, special, punitive, or consequential damages

• We do not guarantee uninterrupted service or data accuracy

• Our total liability for any claim is limited to the amount paid by you in the last 3 months

We are not responsible for:

• Loss of profits or revenue

• Loss of data

• Unauthorized access due to user negligence

• Issues caused by third-party platforms or hosting providers

 

11. Indemnification

You agree to indemnify and hold harmless Enabler Innovations Pvt Ltd, its employees, officers, and partners from any claims, damages, losses, or expenses arising from:

• Your use of the Service

• Violation of these Terms

• Infringement of third-party rights

• Misuse of content or intellectual property

 

12. Termination

We may suspend or terminate your access to the Service immediately if:

• You violate these Terms

• Fraud or suspicious activity is detected

• Payment obligations are not met

Upon termination:

These Terms are governed by the laws of India.

Any disputes will be resolved exclusively in the courts of Ahmedabad, Gujarat, India.
